Agreement of a public offer
for the purchase and sale of goods in the online store by Volina
1. General provisions
1.1. This Agreement is an official and public offer of an individual entrepreneur Savluk Anastasia Mykhailivna (EDRPOU/TIN code 3727304989), hereinafter referred to as the “Seller”, to conclude an agreement for the purchase and sale of goods remotely, namely through the website https://www.volina.in.ua, with any individual or legal entity, hereinafter referred to as the “Buyer”.
1.2. In accordance with Articles 633, 641 of the Civil Code of Ukraine and the Law of Ukraine “On Protection of Consumer Rights”, this agreement is a public offer and is binding on both parties.
1.3. Acceptance of the offer (the fact of placing an order on the website and/or making a prepayment) means the Buyer's full and unconditional agreement with all the terms of this Agreement.
2. Subject of the Agreement
2.1. The Seller undertakes to transfer the goods - women's clothing - to the Buyer, and the Buyer undertakes to accept and pay for them under the terms of this Agreement.
2.2. In addition to standard orders, a pre-order can be placed on the website. The production time for such goods is individual and is communicated by the Seller to the Buyer after placing the order.
3. Prices and payment procedure
3.1. Prices for goods are determined by the Seller in the national currency - hryvnia - and are indicated on the website.
3.2. The Buyer can choose one of the following payment methods:
postpay (payment after receiving the goods at the Nova Poshta branch; at the same time, a minimum prepayment of UAH 200 is made to the Seller's account before sending);
full prepayment by Visa or Mastercard bank card via the website;
full prepayment to the Seller's account using the specified details.
4. Delivery terms
4.1. Delivery of goods is carried out using the Nova Poshta service or by self-pickup from the address: 03189, Ukraine, Kyiv, Yulii Zdanovska St., 48a
4.2. The delivery cost is paid by the Buyer in accordance with the carrier's tariffs.
4.3. The goods are shipped within 7 (seven) business days (from Monday to Saturday) from the moment the order is placed and/or the prepayment is received.
4.4. In the event of production delays (lack of fabric, accessories, correction of a manufacturing defect, etc.), the Seller undertakes to notify the Buyer of the new shipping date no later than 6 (six) days after placing the order.
4.5. The Seller is not responsible for delivery times and possible damage to the goods during transportation by the carrier.
4.6. International delivery is carried out under individually agreed terms and tariffs of the carrier.
5. Return and exchange of goods
5.1. The Buyer has the right to return the goods within 14 (fourteen) days from the date of receipt in accordance with the Law of Ukraine "On Protection of Consumer Rights".
5.2. Return is possible provided that:
original packaging;
invoice (receipt).
5.3. Exchange of goods for another size is possible if the corresponding goods are available in stock. To do this, the Buyer must first agree on the terms of exchange with the Seller.
5.4. The Buyer shall bear the delivery costs for return/exchange, except in cases of receipt of goods of inadequate quality due to the Seller's fault.
6. Responsibility of the parties
6.1. The Seller is responsible for the accuracy of the information about the goods posted on the website.
6.2. The Seller is not responsible for:
the actions and delivery times of the carrier;
incorrectly specified Buyer data when placing an order;
untimely receipt of the order by the Buyer.
7. Processing of personal data
7.1. By placing an order, the Buyer gives the Seller consent to the processing of his personal data within the framework of the Law of Ukraine "On Personal Data Protection".
7.2. The Seller uses personal data solely for the purpose of fulfilling this Agreement: processing the order, making delivery, informing the Buyer and providing service support.
7.3. The Seller undertakes not to transfer personal data to third parties, except in cases where it is directly necessary for the fulfillment of the order (delivery services, payment systems).
8. Dispute Resolution Procedure
8.1. All disputes and disagreements that may arise between the parties shall be resolved through negotiations and electronic correspondence.
8.2. If an agreement is not reached, the dispute shall be subject to judicial resolution in accordance with the current legislation of Ukraine at the place of registration of the Seller.
9. Term of the Agreement
9.1. This Agreement shall enter into force from the moment of acceptance by the Buyer and shall be valid until the parties have fully fulfilled their obligations.
9.2. The Seller has the right to change the terms of this Agreement, with the new version entering into force from the moment of its publication on the website.
